Notice of TSA’s AGM 2022 and Proposed Changes to Constitution

Proposed Changes to TSA’s Constitution

At its meeting on 2 July 2022 the TSA Committee discussed a number of potential changes in relation to handling of member complaints and disputes. Whilst to date TSA has had very few, if any formal complaints from members, several service industries are moving towards putting detailed complaints handling procedures in place. In some instances, this is being driven by regulators. It also recognises the increasing response and feedback received from customers online and via social media.

A comparison of the TSA Constitution and the NSW Fair Trading Model Constitution was undertaken – to ensure the TSA Constitution was still up to date in the areas related to member complaints and disputes. A comparison of the two Constitutions showed some gaps in the TSA Constitution – in particular in relation to the handling of disputes if they are not resolved by mediation.

As a result, the TSA Committee recommends changes to the TSA Constitution, as it will more adequately enable TSA to deal with disputes, should they occur and not be resolved by mediation. It is also recommended to include the content that gives TSA the option not to respond a member complaint if it is perceived to be frivolous or vexatious.

The TSA Committee proposes these change to its Constitution for approval by members at its AGM to be held on Saturday 5 November 2022, 2pm AEDT.
